This law is unjust for coal ravaged communities which will now be subjected to water raids and to those areas already reeling from shale gas development, and heaps further harm on Pennsylvania\u2019s injured environment,\u201d said Tracy Carluccio, Deputy Director, Delaware Riverkeeper Network.<\/strong><\/p>\n <\/p>\n \u201cWe’re disappointed that Governor Wolf didn’t listen to our nearly 300 members who wrote him a letter asking him to veto this bill. The bottom line is this law takes us in the wrong direction. We should be removing exemptions polluters enjoy, not reinforcing their exemptions or adding to them,\u201d said\u00a0Steve<\/strong>\u00a0<\/b>Hvozdovich, Pennsylvania Campaigns Director for Clean Water Action<\/strong>. <\/p>\n The letter states<\/b>, \u201cPeer-reviewed science does not support the General Assembly\u2019s claims that treated coal mine water is \u2018an acceptable source of water\u201d and can be \u201ceffectively substituted for fresh water\u2019 for use in oil and gas well development. In fact, very little research is available on how mine water reacts with fracking chemicals and information that is available exposes several problems that can result from the use of mine water \u2013 problems that responsible parties could be shielded from if this bill is enacted.\u201d<\/p>\n <\/p>\n The letter goes on to address problems with an amendment in the final version of the bill,<\/b>\u00a0stating, \u201cFirst, the amendment is BROADER than the original Section 5 of SB 875 \u2013 it reads that even treated mine water NOT being used in oil and gas development would be exempted from the definition of \u2018solid waste\u2019. Secondly, the amendment could be interpreted to apply to ALL mine drainage, not only treated mine water because \u201ctreated\u201d is not used as a modifier before mine drainage in the amendment. This could mean the bill could incentivize water withdrawals of raw mine drainage, as SB411 had sought to do, which increases the risk of pollution from dangerously contaminated water to other parts of the state and to the Commonwealth\u2019s ground and surface waters from untreated mine pool water and discharges. Lastly, under the complex interplay of the applicable statutes, it can reasonably be interpreted that only treatment sludges from mine drainage plants are currently exempt from the Solid Waste Management Act; the effect of the bill will be to remove important environmental regulation that currently applies to mine drainage and treated mine water when used in oil and gas development. This will open up new pollution pathways while granting waivers of liability to companies that would be responsible.\u201d<\/p>\n <\/p>\n \u201cGov. Wolf has sadly now given the drilling industry and the coal mining industry a new exemption, a new loophole.\u00a0\u00a0The bill provides no mechanism to assure that the mine water has actually been treated.\u00a0\u00a0There is nothing in the bill, no treatment verification or tracking system,\u00a0that provides any means for the DEP or the public to know when or where an oil or gas operator acquires treated mine water from a coal mine operator, where this treated water will be used, whether the mine water has actually been treated in accordance with a DEP permit. We are asked to\u00a0\u2018trust\u2019\u00a0– and the result will be that\u00a0the people of the Commonwealth will suffer the effects of more untreated pollution,\u201d said B. Arrindell, Director of Damascus Citizens for Sustainability<\/b>.<\/p>\n <\/p>\n “If you thought it was impossible to make the fracking wastewater situation worse, think again; SB875 has done exactly that. <\/p>\n \u201cSimilar bills had been introduced in recent years and, each time, they were held back thanks to strong opposition by the environmental community and the public. SB 875 generated the same response, yet Governor Wolf turned a deaf ear to the advocates and concerned citizens who were calling on him to put the people\u2019s needs over those of the industry,\u201d said Karen Feridun, Founder of Berks Gas Truth<\/b>.<\/p>\n <\/p>\n ###<\/p>\n
