Word has it that the PA House is likely to vote on HB 1904 on Wednesday. If the bill passes, the Allegheny National Forest in PA will be one step closer to being opened up to drillers. The Allegheny is the only national forest in PA. The news just came last evening, so we only have one day to call our representatives and tell them to vote NO! AN ACT<\/p>\n

\nAmending the act of May 11, 1911 (P.L.271, No.173), entitled
\n2
\n“An act empowering the United States of America to acquire
\n3
\nland in the State of Pennsylvania for National Forest
\n4
\nReserves, by purchase or by condemnation proceedings; and
\n5
\ngranting to the United States of America all rights necessary
\n6
\nfor control and regulation of such reserves,” further
\n7
\nproviding for enforcement.
\n8
\nThe General Assembly of the Commonwealth of Pennsylvania
\n9
\nhereby enacts as follows:
\n10
\nSection 1. Section 3 of the act of May 11, 1911 (P.L.271,
\n11
\nNo.173), entitled “An act empowering the United States of
\n12
\nAmerica to acquire land in the State of Pennsylvania for
\n13
\nNational Forest Reserves, by purchase or by condemnation
\n14
\nproceedings; and granting to the United States of America all
\n15
\nrights necessary for control and regulation of such reserves,”
\n16
\nis amended to read:
\n17
\nSection 3. That the said United States of America is hereby
\n18
\nempowered to pass such laws, and to make or provide for the
\n19
\nmaking of such rules, of both a civil and criminal nature, and
\n20
\nprovide punishment for the violation thereof, as in its judgment<\/p>\n

\nmay be necessary for the management, control, and protection of
\n2
\nsuch lands acquired from time to time by the United States of
\n3
\nAmerica under the provisions of this act: Provided, however,
\n4
\nThat the authority hereby given shall be subject to all the
\n5
\nconditions and stipulations and reservations contained in this
\n6
\nact[.], including:
\n7
\n(1) As to real property located within the proclamation
\n8
\nboundary of the Allegheny National Forest, except as set forth
\n9
\nin paragraph (2), the Commonwealth does not consent to and the
\n10
\nUnited States is not empowered to pass laws or make or apply
\n11
\nrules under this section with respect to nonacquired estates in
\n12
\nland, nonacquired property interests or nonacquired rights in
\n13
\nsurface land.
\n14
\n(2) With respect to the application of laws and rules under
\n15
\nthis section to nonacquired estates in land, nonacquired
\n16
\nproperty interests or nonacquired rights in surface land,
\n17
\nexcepted or reserved in an instrument of conveyance at the time
\n18
\nsurface lands were conveyed to the United States, only those
\n19
\nlaws and rules disclosed at the time of conveyance and
\n20
\nspecifically expressed in and made a part of the instrument of
\n21
\nconveyance may be applied.
\n22
\n(3) With respect to a nonacquired estates in land,
\n23
\nnonacquired property interests or nonacquired rights in surface
\n24
\nland, excepted or reserved from the surface estate, which were
\n25
\nacquired by the United States before the surface estate was
\n26
\nconveyed to the United States, no laws nor rules under this
\n27
\nsection may be applied.
\n28
\n(4) No laws nor rules under this section may supersede,
\n29
\ninvalidate or modify the common law of the Commonwealth or a
\n30
\nstatute of the Commonwealth respecting any of following:

\n(i) The storage, control, use or development of water
\n2
\nresources in this Commonwealth or any riparian rights
\n3
\nappurtenant and incident to water resources.
\n4
\n(ii) The development, use or ownership of mineral resources
\n5
\nin this Commonwealth.
\n6
\nSection 2. This act shall take effect in 60 days.
